O.G.G.A. 16-11-41 Public Drunkenness
Under Section 16-11-41, someone could be arrested for public drunkenness when:
- A person appears intoxicated in any public place.
- He or she is intoxicated within the land surrounding a private residence that is not their own other than by invitation of the owner or lawful occupant.
- In these places, he or she is boisterous, loud, or uses vulgar or profane language.
If a person is intoxicated in a public place such as a bar, nightclub, or while walking home from a bar on a public street, or at a restaurant or hotel, or on someone else's property while uninvited, or anywhere else in public, and he or she is loud, or uses profanity, they can be arrested and charged with public drunkenness – a misdemeanor offense.
